Agreement

BY USING WHAT IS DISH ("SERVICE"), YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.

THIS AGREEMENT CONTAINS ARBITRATION AND CLASS ACTION WAIVER PROVISIONS (SECTIONS 13-14) THAT AFFECT YOUR LEGAL RIGHTS.

1. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into this agreement.

2. Service Description

what is dish is a web application that uses artificial intelligence to:

• Translate restaurant menu photographs
• Convert prices to different currencies
• Provide estimated nutritional information
• Generate AI images of dishes
• Offer personalized food recommendations

The Service is accessible at whatisdish.app

3. Artificial Intelligence Disclaimer

ALL CONTENT GENERATED BY THE SERVICE IS PRODUCED BY ARTIFICIAL INTELLIGENCE AND IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY.

3.1 AI-generated content may contain errors, inaccuracies, omissions, or misinterpretations.

3.2 Translations are approximations and may not accurately convey meaning, context, or cultural nuances.

3.3 AI-generated dish images are artistic representations, NOT photographs of actual food. Actual dishes may differ significantly.

3.4 Recommendations are algorithmically generated and may not reflect your actual preferences or needs.

3.5 The Service does not provide professional advice of any kind, including medical, nutritional, dietary, legal, or financial advice.

4. Health and Safety Warnings

• All calorie and nutritional values are ESTIMATES ONLY
• Actual values may vary significantly (±50% or more) based on portion sizes, preparation methods, and recipe variations
• DO NOT use for medical dietary planning or management of health conditions

4.3 Price Conversions

• Currency conversions are approximate and may be delayed or inaccurate
• Always confirm actual prices with the restaurant

5. User Responsibilities

By using the Service, you agree to:

• Verify all information with restaurant staff before making decisions
• Not rely solely on AI-generated content for health-related decisions
• Provide accurate account information
• Maintain the security of your account credentials
• Comply with all applicable laws

6. Acceptable Use

You agree NOT to:

• Use the Service for illegal purposes
• Attempt unauthorized access to the Service or other accounts
• Interfere with or disrupt the Service
• Use automated systems or bots without authorization
• Reverse engineer or copy the Service
• Upload content you do not have rights to share
• Violate any third-party rights

Violations may result in immediate termination without refund.

7. Intellectual Property

7.1 The Service, including all software, AI models, designs, and content, is owned by Kaedetaki LLC and protected by intellectual property laws.

7.2 "what is dish" and related logos are trademarks of Kaedetaki LLC.

7.3 You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes.

7.4 You may not copy, modify, distribute, sell, or reverse engineer the Service.

8. User Content

8.1 You retain ownership of content you upload but grant us a worldwide, royalty-free license to use it for operating the Service.

8.2 We may create anonymized, aggregated data from usage patterns which we may use for any purpose, including commercial purposes.

9. Third-Party Services

The Service may integrate with third-party services including payment processors. Your use of such services is subject to their respective terms and privacy policies.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

WE DISCLAIM ALL WARRANTIES, INCLUDING:

• Merchantability
• Fitness for a particular purpose
• Accuracy, reliability, or completeness
• Uninterrupted or error-free operation

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

11.1 Kaedetaki LLC shall NOT be liable for any:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or business opportunities
• Personal injury, illness, or death
• Allergic reactions or adverse health effects
• Incorrect food orders
• Any damages arising from AI-generated content

11.2 Our total liability shall not exceed the greater of:

• Amounts paid by you in the 12 months preceding the claim, OR
• One hundred US dollars (USD $100)

11.3 These limitations apply regardless of the legal theory and even if we have been advised of the possibility of such damages.

12. Indemnification

You agree to indemnify and hold harmless Kaedetaki LLC from any claims, damages, losses, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any laws or third-party rights
• Food consumption decisions based on Service information
• Any allergic reactions, illness, or health issues related to your use

13. Dispute Resolution

13.1 Informal Resolution. Before formal proceedings, contact legal@whatisdish.app to attempt resolution for at least 30 days.

13.2 Arbitration. Unresolved disputes shall be settled by binding arbitration administered by the Dubai International Arbitration Centre (DIAC) in Dubai, UAE, in English, by a single arbitrator. The arbitrator's decision is final.

13.3 Exceptions. Either party may seek injunctive relief in court to protect intellectual property rights.

13.4 Opt-Out. You may opt out of arbitration by emailing legal@whatisdish.app within 30 days of first accepting these Terms.

14. Class Action Waiver

YOU AND KAEDETAKI LLC AGREE THAT DISPUTES WILL BE RESOLVED INDIVIDUALLY, NOT AS CLASS ACTIONS OR COLLECTIVE PROCEEDINGS.

The arbitrator may not consolidate claims or preside over class proceedings.

15. Governing Law

These Terms are governed by the laws of the United Arab Emirates. Subject to arbitration, disputes shall be brought in the courts of Sharjah, UAE.

16. International Use

16.1 Users outside the UAE are responsible for compliance with local laws.

16.2 EU/EEA users retain mandatory rights under applicable consumer protection laws.

16.3 We do not represent that the Service is appropriate for use in all locations.

17. Termination

17.1 You may terminate your account at any time through account settings or by contacting support@whatisdish.app.

17.2 We may suspend or terminate your access at any time, with or without cause or notice.

17.3 Upon termination, your license ends immediately. Sections 3-14 survive termination.

18. Modifications

We may modify these Terms at any time. Material changes will be notified via email or in-app notice at least 30 days before taking effect. Continued use after changes constitutes acceptance.

19. General

19.1 These Terms, with the Privacy Policy and Purchase Terms, constitute the entire agreement.

19.2 If any provision is unenforceable, it shall be modified minimally or severed; remaining provisions continue in effect.

19.3 Our failure to enforce any provision is not a waiver.

19.4 You may not assign these Terms; we may assign freely.

19.5 These Terms are in English. English governs if translated.
